Intercept Music - AI Policy / AI Guidelines

The following Intercept Music, Inc. – AI Policy / AI Guidelines are supplemental to and in addition to the Intercept Music Terms and Conditions for Websites and Services Use, the Intercept Music Privacy Policy, and the Intercept Music End User License Agreement (collectively, the “Intercept Agreements”). Nothing set forth in this Intercept Music - AI Policy / AI Guidelines shall serve to modify, limit, or restrict the terms and conditions of the Intercept Agreements. All terms defined herein shall have the same meaning as set forth in the Intercept Agreements unless specifically defined herein.

1. AI - Core Intercept Music Principles

Intercept Music supports music that is fundamentally human-created. While AI can assist, it must not dominate the creative process. We welcome innovation—but music at Intercept Music must remain human at its core. AI is a tool used by human beings in the creation of art; AI is not itself a creator. AI-Content (defined below) is permitted on the Intercept Music Services, but it must follow strict copyright and licensing rules and be fully compliant with our AI Policy / AI Guidelines and Intercept Agreements.

2. AI Content Guidelines

AI-Content (defined herein) is permitted on the Intercept Music Services, but it must follow strict copyright and licensing rules and be fully compliant with these AI Policy / AI Guidelines and the Intercept Agreements.

In accordance with the terms and conditions of the Intercept Agreements, you are responsible for all content you upload and/or share to or from the Services, including, without limitation, all music, text, images, and associated data ("Content"). This means that you are also responsible for any Content generated by you (“AI Content”) using any Generative AI or AI-powered products, features, and tools (collectively, “AI Products”). You agree that you will not use any AI Product to create any AI Content that is harmful, misleading, or violates the rights of any person or party. You are also responsible for ensuring that any and all AI Content complies with all applicable laws and regulations before using our Software and/or uploading AI Content to the Services. Without limiting the foregoing, by uploading any AI Content to the Services, you affirm, represent and warrant that such transmission or submission of the AI Content is not in violation of any applicable laws, contractual restrictions or other third party rights, and that you have a license and/or express permission from any third party to include or use any intellectual property owned and/or controlled by such third party in the AI Content.

3. AI Content Disclosure:

You must disclose all AI Content intended to be uploaded by you to the Services at the time such AI Content is submitted by you to us for review prior to such AI Content being uploaded to our Services.

4. Content Review Process:

Intercept employs a combination of automated tools and human review processes to monitor and manage Content (including AI Content) that is uploaded to the Services to ensure compliance with our AI Policy / AI Guidelines and compliance with the Intercept Agreements (“Content Review Process”).

The Content Review Process may include the following steps:

• Automated Detection:
  Intercept uses automated tools to scan and flag Content (including AI Content) that may potentially violate our AI Policy / AI Guidelines and/or the Intercept Agreements.
• Human Review:
  Intercept’s Content review teams review flagged Content when necessary to determine appropriate actions, ensuring accurate enforcement of our AI Policy / AI Guidelines and Intercept Agreements.
• Content Removal or Warning:
  Content found to be in violation of our AI Policy / AI Guidelines and Intercept Agreements may be removed, and you may receive warnings or restrictions based on the severity of the violation. Be advised that notwithstanding the foregoing, Intercept may remove your Content immediately if it is flagged as potentially violating our AI Policy / AI Guidelines and/or the Intercept Agreements without any warning or notice from us to you.
• User Appeal of the Removal of Content:
  You can contact us regarding the removal of your Content that Intercept removed under its Content Review Process. If you contact us regarding our removal of Content based on our Content Review Process, Intercept will reassess the Content and reevaluate Intercept’s initial decision.
• Final Decision:
  Following Intercept’s reassessment and reevaluation of the flagged and removed Content, Intercept shall without liability and in its sole discretion decide whether the flagged/removed Content remains removed from the Services or such Content is reinstated on the Services.
• Additional Penalties:
  Without limiting the foregoing, additional penalties for uploading Content that violates our AI Policy / AI Guidelines and/or the Intercept Agreements may include suspension of your use of the Services and/or termination of your use of the Services.
